General conditions of Sale

About us


The Company LAKANA, SAS, with capital of 1,000 euros, whose registered office is at ASNIÈRES-SUR-SEINE (92600) 18 rue du Général Mangin, registered in the NANTERRE Trade and Companies Register under number 882 675 275, represented by Mr Mandrindra Gaël RABESON (hereinafter the "Company"). The company offers the following services : River transport of people.


Preamble

 

These General Terms and Conditions of Sale (hereinafter the "GTC") form the sole basis of the business relationship between the parties.

They frame the conditions under which the company provides its services to its customers. They apply to all services provided by the company for all customers and will be systematically communicated to the customer who requests them.

 

Any order implies acceptance of the GCS.


Definitions


Customer means any person who places an order;

- Sales Order shall mean any reservation made by the Client with a view to benefiting from the Company's services;

- Customer means any person who places an order;

- General Terms and Conditions of Sale or GCS refer to the present document;

- Consumer refers to the buyer, who is a natural person acting outside his professional activity;

- Professional refers to the buyer, whether a legal entity or a natural person, who acts within the framework of his professional activity;

- Services means all services offered by the Company; and

- Company means the company LAKANA SAS, more fully described in Article I hereof.


Orders


Orders are placed by the customer by direct contact, through a reservation platform or through this website.

Sales of services are made after a quotation has been drawn up for the customer, acceptance of this quotation by the customer and express acceptance of the order by the Company.

  

 

Provision of services and prices


The rates are those in force on the day the order is placed, as established on the quotation provided to the Customer or according to the scale indicated to the Customer.

The prices are presented all taxes included (TTC). 

 

For each order, an invoice is drawn up by the company for the customer.

 

The company may allow the customer to benefit from price reductions, discounts and rebates according to the number of services ordered or according to the regularity of the orders, according to the conditions set by the company.


Terms and conditions of payment


The price is payable cash, in full, on the day of the order.

 

Payment can be made by :

Cancellation

1/ By the customer's doing

The customer can cancel or modify any order, free of charge, up to 24 hours before the start of the service. If the 24-hour period is not respected, LAKANA reserves the right to invoice the full amount of the service. In the event of unfavourable weather conditions, the modification or cancellation will also be free of charge on the day of the service. 

 

2/ By the fact of LAKANA

As navigation on the Seine is subject to regulations, the company reserves the right to cancel a cruise including the day of departure in the event that an authority takes a measure that could affect the quality of the cruise.

 

Similarly, the company reserves the right to cancel a service if it deems that the sailing conditions are unfavourable to the smooth running of the cruise. These conditions are assessed according to the weather, the flooding of the Seine, possible damage to the boat or any other element that may threaten safety on board. 

 

In the case of a cancellation due to the company, the amount paid will be fully refunded.

Realization of the services

The company undertakes to respect the deadlines announced at the time of placing the order as much as possible. 

 

The company cannot be held liable for delays caused for reasons of force majeure, i.e. due to the occurrence of an unforeseeable, irresistible event beyond the company's control.


Claim


For all orders made, the customer has a right of complaint within 10 days of the provision of the service.

To exercise this right of complaint, the customer must send the Company, at gael@lakana.co a statement in which he expresses his reservations and complaints, together with the relevant supporting documents.

A complaint that does not comply with the conditions described above will not be accepted.

If the complaint is deemed admissible and justified, the Company may reimburse and/or rectify the service as soon as possible and at its own expense, within the limits of its possibilities.


Personal data


The purchase by the customer may involve the processing of his personal data. If the customer refuses the processing of his data, he is asked to refrain from using the services

This processing of personal data is carried out in compliance with the General Data Protection Regulations 2016/679 of 27 April 2016.

In addition, in accordance with the French Data Protection Act of 6 January 1978, the customer has the right to question, access, correct or modify all personal data at any time by writing to the following address: gael@lakana.co.

 

This personal data is necessary to process his order and to draw up his invoices if necessary, as well as to improve the services offered by the Company.

 

Changes


The information and prices appearing in the company's catalogues are given as an indication and may be revised at any time. The company has the right to make any changes that it deems useful. When placing an Order, the client is subject to the stipulations set forth in the General Terms and Conditions of Sale in force at the time the order is placed.

 

Intellectual Property


The brand, logo and graphic charter are registered trademarks whose ownership is the exclusive property of the company. Any distribution, exploitation, representation, reproduction, whether partial or complete without the express authorisation of the said company will expose the offender to civil and criminal prosecution.

Attribution of competence clause


The law governing the GTC is French law. Any dispute that may arise between the Company and a Client during the execution of the GCS shall be subject to an attempt at amicable resolution. Failing this, disputes will be brought to the attention of the competent courts of common law.

 

Client Acceptance


The Customer expressly accepts the GTC. He declares that he is aware of them and waives the right to rely on any other document, in particular his own general terms and conditions of purchase.

Rules

1/ The customer is asked to arrive five minutes before boarding at the place agreed in advance.

 

2/ In the event of a passenger's delay, the company reserves the right to shorten the duration of the service without any adjustment to the price.

 

3/ The company reserves the right to deny boarding to one or more passengers in the following cases: advanced state of intoxication, use of narcotics or any other behaviour threatening the safety of the boat and passengers. 

 

4/ On board, all passengers are asked to follow the crew's instructions throughout the navigation. 

​

5/ In the event of failure to comply with the crew's instructions, the company reserves the right to terminate the service if the captain deems that safety on board is threatened. 

​

6/ The company declines all responsibility in the event of loss, theft or damage to passenger equipment.

 

7/ Parents are asked to be vigilant about their children's behaviour during the cruise and during the embarkation and disembarkation phases.
